Credit agreement made by and between Bank Handlowy w Warszawie SA and TIM SA

Pursunat to the above Annex No. 17, the Bank increased the amount of credit from PLN5 million _in words: PLN five million to PLN10 million _in words: PLN ten million _. The remaining basic parameters of the credit have not been changed, i.e. the repayment date falls on 02.02.2018, and the interest rate of the credit is calculated based on WIBOR 1M plus the Bank margin.

In accordance with the credit agreement, the credit security is as follows: a statement of submission to enforcement up to the amount of PLN12 million and a registered pledge on the stocks up to the amount of PLN20 million.

At the same time, the Management Board of TIM SA informs that, in addition to the agreement on the current account credit referred to above, on 10.11.2016  TIM SA and Bank Handlowy w Warszawie SA entered into an agreement on bank guarantee provided by Bank Handlowy w Warszawie SA, on request of 3LP SA with its registered office in Siechnice, up to the amount of EUR 2.4 million _ in words: EUR two million four hundred thousand _. The Issuer informed about the above agreement in current statement No. 49/2016 of 10.11.2016.

The Management Board of TIM SA indicates that the above information has been considered confidential within the meaning of the definition set out in Article 7 MAR, due to the fact that the total amount of the potential liability of TIM SA towards Bank Handlowy w Warszawie SA arising from the fact of entering into the above agreements may have an impact on the future financial results of TIM SA.
